Where can I get a death certificate?
The Health Department. (Go down Main St. over the railroad tracks and turn right)

How do I get my spouse’s name removed from my deed if it is Joint and Survivorship?
Please contact the Auditor’s/Recorder’s Office to file the proper affidavit.

Do I need to file an estate if there’s nothing titled in the decedent’s name?
No, but property titled in the decedent’s name or refund checks in the name of the decedent may require an estate.

How do we get unclaimed funds of a decedent?
A list is available from Auditor’s Office.  An estate may need to be opened or re-opened to be given authority to claim the funds.

How can I get a value on real estate or a motor vehicle?
Real Estate- can be appraised or a Motion to use Auditor’s Tax Value can be filed.  Motor Vehicles – Kelley Blue Book value/ NADA  can be obtained online or at a bank.

Can the Court recommend an attorney?
No, but you may contact the Trumbull County Bar Association at 330-675-2415.

Do we have a list of appraisers to appraise real estate?
No. They have to be certified and familiar with Trumbull County property values.

What is the cost of filings?
Appendix A of our local rules lists our advance deposits for costs.

What are the court costs due?
Contact the filing counter to inquire as to current costs due.

Do I need an attorney to file at probate?
No, but the Probate Court employees are not permitted by law to assist you in filling out the paperwork or to give legal advice.

On a name change/guardianship/adoption case- do I have to get dads/moms consent if they are no longer in child’s life?
Yes, their consent is required by law unless otherwise ordered by the Court.

Can we look to see if an estate has been filed or a will put on deposit?
Yes
, we search the decedent’s name.

Do we get a Certified Judgment Entry approving accounts?
The fiduciary receives a copy about a month after estate is closed. If you need a certified copy, it must be requested.

Why do I need a bond? 
To Protect the assets of the decedent or ward

Do you need to file receipts with accounts?
Estates after 2002 the filing of receipts is not required but a Certificate of Service must be filed. Guardianships-yes. Trusts- yes.

Do I have to file in person?
No, you can file initial filings by mail or in person. Further filings can be done by fax (and faxes act as original), mail, in person, or e-filed.

Do you take credit cards/personal checks?
We only take cash, check or money orders
